Course Description

This Internet course is designed to acquaint the construction professional with important information related to changes in the contract, construction claims, differing site conditions, and types of construction delays. There is a detailed discussion of owner-ordered changes and how these changes affect the contractors’ responsibility. Bilateral and unilateral changes are discussed, followed by minor changes and how the contractor can file changes for proposed additional work. The legal principles that apply to the differing site condition’s clause of the contract are discussed. A short discussion defines the two types of differing site conditions as well as the process of "risk shifting" because differing site conditions. The last part of this course is dedicated to construction delays and acceleration. Excusable and non-excusable delays are discussed, followed by a short discussion on compensable delays. The course presentation concludes with a a discussion of liquidated damages and contract acceleration.


In order to receive credit for this course the participant must successfully complete a series of quizzes designed to test his/her knowledge of the subject presented in this course. To successfully complete this course, the participant must obtain an aggregate score of all the quizzes of 70% or greater.

Instructor Bio



P.THOMAS GARD, PE, ESQ, PMP
Tom Gard holds a J.D. in Government Contract Law from Catholic University of America, a M.B.A. in Financial Management, Northern Michigan University, a M.S.C.E. in Construction Management from Purdue University, and a B.S. in Urban Planning/Civil Engineering from Michigan State University. He is currently the President of Dominion Project Management, Inc. of Leesburg, Virginia.

 

Mr. Gard is a highly esteemed speaker and writer with regard to engineering management, engineering law and project management subjects. Tom has spoken before the American Bar Association on privatization and various engineering organizations on project management and engineer law topics. He has been published several times in engineering periodicals. He currently is an adjunct professor in the graduate program at George Washington University lecturing and writing on project management topics.
