Course Description

This Internet course is designed to provide the construction professional with valuable information on the following areas: Liability of the Architect & Engineer, Su-contract Formation, Performance & Disputes; Bonds; Builder’s Risk and Liability Insurance Coverage; and The Civil Claims Act.


The first part of the course describes the types of liabilities to which the design and construction professionals are exposed in construction contracting. It delves into professional services, construction contracts, and theories of liability and damages. Additionally, The duties and responsibilities of these professional as well as professional liability insurance are discussed. The second part of the course concentrates on the subcontract formation, performance, and disputes. Here, the process for forming the subcontract is presented. Performance problems, payment problems, and claims are examined. This part closes with a review of the types of construction bonds required. The third part of the course focus on the builder’s risk and liability insurance coverage. It identifies the types of liability insurance available and the recommended coverage. We close this course by offering a short explanation of the Civil False Claims Act and the civil and criminal liabilities that comes with it.


In order to receive credit for this course the participant must successfully complete a series of quizzes designed to test his/her knowledge of the subject presented in this course. To successfully complete this course, the participant must obtain an aggregate score of all the quizzes of 70% or greater.

Instructor Bio



P.THOMAS GARD, PE, ESQ, PMP
Tom Gard holds a J.D. in Government Contract Law from Catholic University of America, a M.B.A. in Financial Management, Northern Michigan University, a M.S.C.E. in Construction Management from Purdue University, and a B.S. in Urban Planning/Civil Engineering from Michigan State University. He is currently the President of Dominion Project Management, Inc. of Leesburg, Virginia.

 

Mr. Gard is a highly esteemed speaker and writer with regard to engineering management, engineering law and project management subjects. Tom has spoken before the American Bar Association on privatization and various engineering organizations on project management and engineer law topics. He has been published several times in engineering periodicals. He currently is an adjunct professor in the graduate program at George Washington University lecturing and writing on project management topics.
